Frenkel & Co. informs us that those members who carry professional liability insurance with the American Home Assurance Company should be prepared for some important changes that will affect our insurance coverage during 1986.
They say that the rise of litigation and punitive awards in the courts and the unpredictability of the legal system have made it impossible to maintain a rate structure that is adequate to pay for future losses. Therefore, a rate increase will be instituted of 35% for all territories, except California, which will be 100%.
Further, there will be a number of changes in the policy terms and conditions. The most significant of these are: First, defense costs will now be part of the policy limit; second, the policy will contain a $25,000 sublimit for all defense costs and damages for claims where one of the allegations is sexual misconduct; third, the policy will contain a $25,000 sublimit for fines, penalties, or punitive damages, where allowable by law.
The most important feature of the policy, the “occurrence” form, has been retained. (Most competitive programs are written on the less desirable “claims made” form.) Complete details regarding all of the changes will be forwarded to you in advance of the renewal date.
